What is important to remember is that there is no one way to determine who retains what assets, whether a decision is made through negotiation or litigation. Even judges use a variety of factors to determine the equitable distribution of the marital estate. Who gets 401ks, stocks, IRAs, investment accounts, and the family home are all issues that can be negotiated by the parties of left the court to decide.
